The relevant laws and regulations regarding the provision of safety helmets and the wearing of safety helmets by workers in the workplace are as follows:
1. Labor Safety and Health Facilities Rules (Revised on June 15, 1994)
Article 238:
Employers should install equipment to prevent objects from falling in the workplace, and provide safety helmets and other protective gear for workers to wear.
Article 278:
Employers should provide appropriate gloves, aprons, leggings, safety shoes, safety helmets, protective glasses, gas masks, safety masks, etc. when carrying, placing, and using sharp objects, protruding objects, corrosive substances, and toxic substances, and ensure that workers use them.
Article 279:
When workers operate or approach a prime mover, power transmission device, power rolling device, or power-operated machinery in operation, and there is a risk that the workers' hair or clothes will be caught, the employer should ensure that the workers wear appropriate clothing and hats.
Article 280:
When there is a risk of falling or scattering objects during work, which may endanger workers, the employer shall provide appropriate safety helmets and other protective equipment.
Article 281:
When workers are working at a height of more than two meters and there is a risk of falling, the employer shall ensure that the workers use safety belts, safety helmets and other necessary protective equipment.
The preceding paragraph does not apply to measures such as safety nets taken by the employer.
Article 282:
When there is a risk of falling objects, poisoning by harmful substances, or lack of oxygen during work such as underground or tunnel engineering, the employer shall ensure that the workers use safety helmets and, if necessary, provide protective equipment such as air respirators, gas masks, dust masks, etc.
Article 290:
For workers engaged in electrical work, the employer shall ensure that they use electrician safety helmets, insulating protective equipment and other necessary protective equipment.
2. Protection measures for workers in overhead operations
Article 10:
Employers shall provide and ensure that workers wear appropriate protective gear such as safety helmets, safety shoes, and safety belts when performing overhead operations, or install safety nets, erect scaffolding, and other protective equipment.
3. Standards for the construction of safe and sanitary facilities (revised on January 31, 1994)
Article 27, paragraph 10:
Employers shall assign work supervisors to the construction scaffolding in accordance with regulations and supervise workers in using safety helmets or safety belts.
Article 50, paragraph 3:
Employers who hire workers to perform open-air excavation operations shall assign special personnel to supervise workers in using safety helmets or safety belts to prevent soil and rock collapse.
Article 58, paragraph 3:
Employers who hire workers to perform retaining support construction operations shall assign trained work supervisors to supervise workers in using safety helmets or safety belts.
Article 72:
Employers who perform tunnel and tunnel operations shall require workers to wear safety helmets and other necessary protective gear. And prepare necessary equipment such as emergency safety rescue equipment, lifting rescue facilities, safety lights, respiratory protection equipment, gas detection alarm system and communication signals.
Article 87, paragraph 3:
When the employer uses the workers for tunnel, tunnel excavation or lining operations, he shall assign trained operation supervisors to supervise the workers to use safety helmets or safety belts.
Article 118, paragraph 3:
When the employer uses the workers for formwork support operations, he shall select trained operation supervisors to supervise the workers to use safety helmets or safety belts.
Article 134, paragraph 3:
When the employer uses the workers for steel structure assembly operations, he shall select trained operation supervisors to supervise the workers to use safety helmets or safety belts.
Article 150:
For the workers engaged in building demolition operations, the employer shall make them wear appropriate personal protective equipment.
IV. Rules for safety and health facilities in forest farms
Article 52:
For workers engaged in mountainous areas, the employer shall provide safety helmets.
5. Labor Safety Rules for Ship Cleaning and Dismantling
Article 10:
Employers shall require all personnel entering the cleaning work site to wear safety helmets, safety shoes and work clothes.
Article 19:
Employers shall require all personnel entering the workplace to wear safety helmets and safety shoes. Workers performing cutting operations shall also wear goggles, masks and face shields; workers performing handling operations shall also wear protective gloves.
Article 28, Paragraph 5:
When employers require workers to enter the cabin for work, they shall check that they are wearing non-permeable work clothes, tools, safety helmets, safety shoes and other personal protective equipment.
6. Safety and Health Facility Standards for Fireworks Manufacturing Industry
Article 36:
Workers' clothing shall be limited to cotton products. Those who come into contact with gunpowder shall wear fireproof aprons, face shields, safety helmets, rubber shoes and cloth shoes to minimize skin exposure. In places where powder is flying, workers shall wear goggles and dust masks.
VII. Standards for Safety and Sanitation Facilities for Loading and Unloading at the Terminal
Article 66:
Employers shall require workers and related personnel who enter the terminal to engage in loading and unloading operations to wear personal protective equipment such as safety helmets.
